Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Where The Bleep ("the App," "W.T.B," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease all use of the App and uninstall it from your device.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, notify you through the App or via other reasonable means. Your continued use of the App following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.

These Terms apply to all users of the App, including both free-tier users and paid subscribers.

2. Description of Service

Where The Bleep is a personal item tracking and inventory management application designed to help you catalog, organize, and locate your personal belongings. The App provides the following features:

• Catalog and organize personal belongings with names, descriptions, photos, and custom metadata
• Create hierarchical storage locations to represent your physical spaces
• Generate and scan QR codes for quick location identification
• Track item check-ins and check-outs, including lending to other people
• Search and filter your inventory across all locations
• Create encrypted backups of your data for safekeeping
• Export your data in CSV, JSON, and PDF formats
• Sync data across multiple devices via encrypted cloud synchronization
• Pair devices for multi-device access to your inventory
• Use optional AI-powered features to generate item descriptions from photos
• Access the App in 19 supported languages

The App is available on iOS and Android platforms. Certain features may vary between platforms or may require a paid subscription to access. We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

3. User Accounts and Authentication

To access certain features of the App, including cloud synchronization and device pairing, you must create an account. When creating an account, you agree to:

• Provide accurate and complete information during the registration process
• Maintain the security and confidentiality of your account credentials
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You are solely responsible for maintaining the security of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. You must be at least 13 years of age to create an account and use the App.

We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if your account poses a security risk to the App or other users.

4. Subscription Terms

4.1 Subscription Plans

Where The Bleep offers premium features through paid subscription plans. The following subscription tiers are currently available:

• Pro Monthly: A recurring monthly subscription providing access to all premium features
• Pro Annual: A recurring annual subscription providing access to all premium features at a discounted rate compared to the monthly plan

Subscription pricing is displayed in the App and may vary by region and currency. We reserve the right to change subscription pricing at any time, provided that any price increase for existing subscribers will take effect only at the start of the next billing cycle following reasonable notice.

4.2 Billing and Auto-Renewal

Subscriptions are billed through the Apple App Store or Google Play Store (collectively, "App Stores"), managed by RevenueCat as our subscription infrastructure provider. By subscribing, you authorize recurring charges to the payment method associated with your App Store account.

All subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless you cancel at least 24 hours before the end of the current billing period. Renewal charges are processed within 24 hours prior to the end of the current period at the then-current subscription price.

4.3 Cancellation

You may cancel your subscription at any time through your device's App Store settings. Cancellation takes effect at the end of the current billing period. Upon cancellation:

• You will retain access to premium features until the end of your current paid billing period
• Your account will revert to the free tier after the paid period expires
• Your existing data, including cloud-synced data, will remain accessible subject to free-tier storage limitations
• No partial refunds are issued for unused portions of a billing period

4.4 Refund Policy

All subscription purchases are processed through the Apple App Store or Google Play Store. Refund requests must be directed to the respective App Store in accordance with their refund policies:

• Google Play Store: Visit Google Play's Refund page or contact Google Play Support

Where The Bleep does not process payments or refunds directly. We have no ability to override or modify the refund policies of the Apple App Store or Google Play Store.

4.5 Free Trial

We may offer free trial periods for subscription plans from time to time. If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial expires. Free trial eligibility is determined by the App Store and is typically limited to one trial per user per App Store account.

5. Encryption and Key Management

5.1 End-to-End Encryption

Where The Bleep employs end-to-end encryption using a zero-knowledge architecture for data synchronization and cloud storage. This means that your data is encrypted on your device before it is transmitted to our servers, and only you hold the keys necessary to decrypt it. We cannot access, read, or recover the contents of your encrypted data.

5.2 BIP39 Recovery Phrase

During account setup, you will be provided with a BIP39 recovery phrase (also known as a seed phrase or mnemonic phrase). This recovery phrase is the sole mechanism for recovering your encryption keys if you lose access to all of your paired devices. You acknowledge and agree to the following:

• Your Responsibility: You are solely and entirely responsible for securely storing your BIP39 recovery phrase. We strongly recommend writing it down on paper and storing it in a safe, secure location separate from your devices.
• No Recovery by Us: Due to our zero-knowledge architecture, we do not have access to your recovery phrase or encryption keys. If you lose your recovery phrase and all paired devices, your encrypted data will be permanently and irretrievably lost. We cannot recover it for you under any circumstances.
• No Liability: We shall not be held liable for any data loss resulting from your failure to securely store your recovery phrase. This includes, but is not limited to, loss of access to your items, locations, photos, check-in/out records, and any other data stored within the App.
• Security: Never share your recovery phrase with anyone. Never store it digitally in unencrypted form (such as in a plain text file, email, or screenshot). Anyone who possesses your recovery phrase can potentially gain access to your encrypted data.

5.3 Encrypted Backups

The App allows you to create encrypted backups of your data. These backups are encrypted using your encryption keys and are protected by the same zero-knowledge principles as your cloud-synced data. You are responsible for the safekeeping of any exported backup files and for ensuring that your recovery phrase is available to restore them if needed.

6. Cloud Services

6.1 Cloud Synchronization

Where The Bleep offers optional cloud synchronization powered by Supabase. When you enable cloud sync, your data is encrypted on your device using your personal encryption keys before being transmitted to and stored on our cloud infrastructure. All data stored on our servers remains encrypted and is inaccessible to us or any third party without your encryption keys.

6.2 Service Availability

While we strive to maintain high availability of our cloud services, we do not guarantee uninterrupted access. Cloud services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. The App is designed to function offline, and cloud sync will automatically resume when connectivity is restored.

6.3 Data Residency

Cloud-synced data may be stored on servers located in various geographic regions. Because all cloud-stored data is end-to-end encrypted, the geographic location of the servers does not affect the security or privacy of your data. By using cloud sync, you consent to your encrypted data being stored and processed in these locations.

7. AI Features

7.1 AI-Powered Descriptions

Where The Bleep offers optional AI-powered features that can automatically generate descriptions for your items based on photos. These features rely on third-party AI service providers, and you must supply your own API keys to use them.

7.2 Supported AI Providers

The App currently supports integration with the following eight AI providers:

• OpenAI
• Anthropic
• Google Gemini
• Cloudflare Workers AI
• Mistral AI
• Groq
• OpenRouter
• Ollama (local/self-hosted)

The availability and specific models supported by each provider may change over time. We are not responsible for the availability, accuracy, pricing, or policies of any third-party AI provider.

7.3 User-Provided API Keys

To use AI features, you must provide your own API keys obtained directly from the respective AI provider. You are responsible for:

• Securing your API keys and keeping them confidential
• Any costs or charges incurred through your use of third-party AI services under your API keys
• Complying with the terms of service and usage policies of each AI provider
• Understanding that photos sent to AI providers for processing are subject to that provider's data handling and privacy policies

Your API keys are stored locally on your device and are not transmitted to our servers. When you use AI features, your photos are sent directly from your device to the selected AI provider for processing.

7.4 AI Output Accuracy

AI-generated descriptions are provided for convenience only and may contain inaccuracies, errors, or omissions. You should review and verify all AI-generated content before relying on it. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated descriptions.

8. Device Pairing

Where The Bleep supports device pairing to enable multi-device access to your inventory. When you pair a new device with your account, your encryption keys are securely transferred to the new device to allow it to decrypt your synced data. You agree to the following:

• You will only pair devices that you own or are authorized to use
• You are responsible for the security of all paired devices
• If a paired device is lost or stolen, you should unpair it from your account immediately through another paired device or by using your recovery phrase
• We are not responsible for unauthorized access to your data resulting from lost, stolen, or compromised paired devices

You may unpair a device at any time through the App's settings. Unpairing a device revokes that device's access to your cloud-synced data.

9. Data Export and Portability

Where The Bleep supports exporting your data to ensure portability and compliance with applicable data protection regulations. You may export your data in the following formats:

• CSV (Comma-Separated Values): A standard tabular format compatible with spreadsheet applications and other data management tools
• JSON (JavaScript Object Notation): A structured data format suitable for programmatic use, data migration, and integration with other applications
• PDF (Portable Document Format): A human-readable document format suitable for printing, archiving, and sharing your inventory records

Exported data reflects the current state of your inventory at the time of export. We do not guarantee compatibility of exported data with any third-party application or service. Exported files are unencrypted and should be handled and stored with appropriate care to protect your personal information.

10. Account Deletion

You may request deletion of your account at any time through the App's settings. Account deletion is comprehensive and irreversible. When you delete your account, the following actions are taken:

• All data stored on our cloud servers associated with your account is permanently deleted
• All device pairings are revoked
• Your subscription, if any, is canceled (you may still need to cancel the recurring payment through your App Store to prevent future charges)
• Your cloud sync configuration and encryption keys stored on our servers are permanently destroyed
• Any locally stored data on your devices will remain on those devices until you manually delete it or uninstall the App

Warning: Account deletion is permanent and cannot be undone. Once your account is deleted, we cannot recover any of your data, restore your account, or reinstate your subscription. We strongly recommend backing up your data before initiating account deletion, as exports cannot be re-imported into the app.

Account deletion may take up to 30 days to propagate across all systems and backups. During this period, residual encrypted data may exist on our backup systems but will not be accessible and will be purged according to our standard retention schedules.

11. User Responsibilities

You agree to use the App in compliance with all applicable laws and regulations. Specifically, you agree to:

• Use the App only for lawful purposes and in a manner consistent with its intended use as a personal item tracking tool
• Not use the App to track items belonging to others without their explicit consent
• Not attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App
• Not attempt to circumvent, disable, or interfere with any security features of the App
• Not use the App in any way that could damage, disable, overburden, or impair our servers or infrastructure
• Not use automated scripts, bots, or other means to access or interact with the App in an unauthorized manner
• Not upload or transmit any malicious code, viruses, or harmful content through the App
• Maintain the security of your devices, account credentials, API keys, and recovery phrase

12. Intellectual Property

The App, including but not limited to its design, user interface, graphics, icons, logos, source code, documentation, and all associated intellectual property, is owned by Where The Bleep and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.

You may not:

• Copy, modify, adapt, or create derivative works based on the App
• Distribute, sublicense, lease, rent, or lend the App to any third party
• Use our trademarks, service marks, trade names, or branding without prior written permission
• Remove, alter, or obscure any copyright, trademark, or proprietary notices in the App
• Use the App for any commercial purpose without a separate written agreement with us

The content you create and store within the App (your items, locations, descriptions, and photos) remains your property. We claim no ownership over your user-generated content.

13. Third-Party Services

The App integrates with or relies upon the following third-party services. Your use of these services is subject to their respective terms of service and privacy policies:

• Supabase: Cloud database and authentication infrastructure -- Terms of Service

• Apple App Store: App distribution and in-app purchase processing for iOS -- Licensed Application End User License Agreement
• Google Play Store: App distribution and in-app purchase processing for Android -- Terms of Service
• AI Providers (OpenAI, Anthropic, Google Gemini, Cloudflare Workers AI, Mistral AI, Groq, OpenRouter, Ollama): Optional AI description generation -- subject to each provider's individual terms of service
• Google Firebase Crashlytics: Automated crash reporting and stability monitoring -- Firebase Terms of Service

We are not responsible for the practices, policies, content, availability, or reliability of any third-party service. Your interactions with third-party services are solely between you and the respective third party. Any disputes arising from your use of third-party services must be resolved directly with that third party.

14. Localization

Where The Bleep is available in 19 languages. While we strive to provide accurate translations, the English-language version of these Terms shall be the authoritative version in the event of any conflict or discrepancy between translations. Localized versions of these Terms are provided for convenience only. If you notice a translation error, please contact us so we can correct it.

15. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHERE THE BLEEP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE APP
• WARRANTIES THAT DEFECTS IN THE APP WILL BE CORRECTED
• WARRANTIES REGARDING THE ACCURACY OF AI-GENERATED CONTENT
• WARRANTIES REGARDING THE AVAILABILITY OR RELIABILITY OF CLOUD SYNCHRONIZATION SERVICES

You acknowledge that you use the App at your sole risk. No advice or information, whether oral or written, obtained from us or through the App shall create any warranty not expressly stated in these Terms.

We do not warrant that the App will meet your specific requirements, that the results obtained from using the App will be accurate or reliable, or that the quality of the App will meet your expectations.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHERE THE BLEEP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
• Loss of data, including but not limited to loss resulting from failure to secure a recovery phrase, device loss, or account deletion
• Loss of profits, revenue, business opportunities, or goodwill
• Damages resulting from your use of or inability to use the App
• Damages resulting from unauthorized access to or alteration of your data or transmissions
• Damages resulting from the conduct of any third party in connection with the App
• Damages arising from the use of third-party AI services or the accuracy of AI-generated content
• Damages arising from interruption or unavailability of cloud synchronization services
• Any costs incurred through third-party AI providers under your API keys

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US $100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

17. Indemnification

You agree to indemnify, defend, and hold harmless Where The Bleep and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App or any activity under your account
• Your violation of these Terms
• Your violation of any applicable law, regulation, or rights of any third party
• Any content or data you submit, transmit, or store through the App
• Your use of third-party AI services, including any claims related to content processed through your API keys

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction located in the State of Texas.

You agree that any legal action or proceeding related to these Terms shall be brought exclusively in the state or federal courts located in the State of Texas, and you hereby consent to the personal jurisdiction of such courts.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent. If such modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any individual provision shall not affect or impair the validity, legality, or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and Where The Bleep with respect to your use of the App. These Terms supersede all prior or contemporaneous communications, agreements, representations, and understandings, whether oral or written, between you and Where The Bleep regarding the subject matter hereof.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
